General Terms and Conditions
CANCELLATION
All membership fees are paid in advance and are non-refundable.
NO SMOKING
No smoking allowed inside the guest houses or on the property, except for designated areas. We do not allow smoking tobacco, marijuana, illegal drugs, e-cigarettes, vape pens, vaping, cartridges containing the liquid of nicotine, hookahs, incense, cooking, cigars, candle burning, the use or diffusing of patchouli oil or other strong-smelling plant-based essential oils or synthetic products in our facility. This policy is not intended to stop people from smoking, but to regulate where they smoke and how it affects others. A $500 penalty will apply for smoking inside the guest houses.
Waiver and Release of All Claims
I, , the undersigned (hereinafter referred to as "I", "Guest" or Member), assume full and complete responsibility for any injury or accident that may occur during my participation in any recreational activity sponsored by Valley Rock Inn and Mountain Club, and its affiliates. I hereby release and hold harmless Valley Rock Inn and Mountain Club and any and all affiliates, other promoters and other persons and entities associated with Valley Rock Inn and Mountain Club, as well as their directors, officers, partners, agents, volunteers, employees, attorneys and administrators (hereinafter "Valley Rock"). Further, I do expressly hereby forever release and discharge Valley Rock Inn and Mountain Club from all claims, demands, injuries, damages, actions, or cause of action, and from all acts of active or passive negligence on the part of Valley Rock. I fully understand these terms, have had an opportunity to discuss them with a representative of Valley Rock, and agree to these terms in consideration of the use of a swimming pool, heated whirlpool, frigid plunge bath, sound baths, sauna, hyperbaric oxygen chamber, bicycle, kayak, foam rolling, fitness and gym equipment, electromyostimulation machines (EMS) hiking trails and other equipment or by engaging in fitness or recreational activities including, but not limited to hiking, walking, running, riding, personal training, functional HIIT, yoga, EMS participation, massages, meditation, manifestation, dancing and attendance at lectures and presentations (hereinafter the "Activities" or the "Equipment") provided by Valley Rock.__
I understand that participating in the Activities offered may expose me to risk of injury or death. Furthermore, I understand that Valley Rock makes no representation about the safety or condition of any route taken, whether by bicycle or by foot, the skill or ability of any Guest or Member or staff who may participate in such Activities, the mechanical condition of the Equipment, or any other condition, location, or persons that affect the safety, comfort, or well-being or any Guest or Member or staff rider. Further Valley Rock makes no representation of the safety of its Equipment, other members, or any Activities offered. It is further agreed that I undertake my participation in these Activities at my sole risk. I understand and agree that as a condition of my participation in such Activities I must always conduct myself in a legal and safe manner at all times and that I will not engage in any Activity or use any Equipment while under the influence of alcohol, illegal drug, or prescription medication that provides a warning against the use of such Equipment or such Activities. I certify that I have had the opportunity to inspect the Equipment prior to the ride or activity. I further agree that I am solely responsible for inspecting and ensuring the safety of the Equipment or Activities provided to me. I understand that should I find an unsafe condition it is my responsibility to notify a representative of Valley Rock immediately. I understand and agree that New York Law shall govern this Waiver and Release.__
Duration of Agreement
I understand and agree that this agreement shall remain in effect for the duration of my membership with Valley Rock; or the duration of my sponsored activity, whichever is longer. __
Assumption of Risks: I am aware that using Equipment and participating in any of the Activities involves many risks, dangers and hazards, including but not limited to: hiking, walking or traversing on rough and uneven terrain; changing weather conditions which may cause the trails, walkways and parking areas to be muddy, slippery or to have unexpected depressions, bumps, ruts, rocks or other conditions which could cause me to fall and be severely hurt, or even killed; the danger of impact or collision with natural or man-made obstacles and hazards, or other participants, negligence of other participants and NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN SWIMMING, MOUNTAIN BIKING, KAYAKING, HIKING, AND OTHER FITNESS OR RECREATIONAL ACTIVITIES I FREELY ACCEPT AND ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND LOSS RESULTING THEREFROM.__
